Builders’ Lien

A construction or builders' lien gives contractors, subcontractors, suppliers, and labourers a method to collect money owed to them for labour and materials used to improve the land.

Anyone who makes or causes to make improvements by providing work or materials for an owner, contractor or subcontractor may file a Builders' or
Construction lien.

In Alberta a builders' lien must be registered at the Land Titles Office within 45 days after the work is completed or the materials supplied.

In British Columbia a lien must be filed within 45 days after the issuance of the Certificate of Completion, or if not applicable, within 45 days after completion, abandonment or termination of the Head Contract, or else the claim will be invalid.

In Saskatchewan, the lien arises when the work is begun, services are first rendered, or the first material is supplied. The amount of a claimant's lien is limited to the actual value of services rendered, subject to the statutory hold-back provisions. No lien exists for a claim of less than $100. Liens must generally be registered within 40 days of the completion of the work.

Ontario requires that a lien must be filed within 45 days of the last supply of work or material.  To protect your lien rights, you must perfect your lien within 90 days of filing your lien if you are not paid. 

In the event you must sue to prove/perfect your lien, you should be aware that Lien-Pro does not diarize the exact deadline of when this action must be commenced. It is the responsibility of the Customer.    

Lien-Pro does not prepare the lien, but will assist you in having the lien prepared by a qualified solicitor at preferred rates, and we will take all possible steps to ensure your lien is filed at the Land Title Office within the time requirements. Fees charged are comprised of a facilitation fee and the full cost of a qualified legal professional in the preparation and filing of your lien.
